Two illegal aliens arrested in Knox County back in November on charges of organized retail crime will soon see their day in criminal court.
24-year old Pinky Kvec and 25-year-old Maricel Mihai were arrested for violating the Organized Retail Crime Prevention Act.
Tennessee code states that a person commits organized retail crime when they work alongside one or more individuals to steal merchandise totaling more than $1000 over a 90-day period with the intention of either a) selling, bartering, or trading the merchandise for money or other gain or b) fraudulently returning the merchandise.
An individual can also be charged with organized retail crime if they knowingly receive, possess, purchase, or sell merchandise or stored value cards such as store gift cards that have been obtained through a fraudulent return.
Both Kvec and Mihai originally appeared in general sessions court on the charges. On December 9, both were bound over mitt, meaning the sessions court judge issued an order requiring that they remain in jail while awaiting a criminal trial.
Inmate records indicate that both individuals have an immigrant detainer hold. This means they will remain in custody until they are turned over to U.S. Immigration and Customs Enforcement.
An immigrant detained most likely indicates that the two were in the country illegally.
