Bill To Limit Foreign Ownership Property In Tennessee Heads To Committee

After deferring action on House Bill 0040 (HB0040) during a committee meeting on February 8th, the House Property and Planning Subcommittee has scheduled the bill to be heard this Wednesday.

Representative Jay Reedy (R-Erin-District 74) is sponsoring this bill in the house alongside Republican co-prime sponsors Representatives Kevin Raper, Bud Hulsey, Todd Warner, and Greg Vital. 

Sen. Frank Niceley (R-Strawberry Plains-District 8) is sponsoring the corresponding Senate Bill (SB0122) alongside his co-prime sponsor Senator Janice Bowling. 

As introduced, the legislation “prohibits foreign ownership of real property in this state by nonresident aliens and foreign entities if the laws of the country where such aliens reside, or such entities are located, prohibit citizens of the United States or its territories or possessions from purchasing real property located within that country.”

The bill also maintains that any property owned by a “Non-Resident Alien” or “Foreign Business Entity” before July 1st, 2023 will not be divested, but must be registered with the Tennessee Secretary of State.

As it is right now, Senate Bill 0122 has been referred to the Senate Commerce and Labor Committee but has not been scheduled for a hearing yet.

House Bill 0040 has been assigned to the House Property and Planning Subcommittee and placed on their calendar for consideration on February 22nd, 2023.

  1. It’s a step in the right direction, but not nearly inclusive enough. No one should be allowed to own property in Tennessee unless the live here already or plan to do so.

  2. Does “foreign business entity” include Bill Gates? Or “non resident alien?” Some would argue he is an alien… besides your every day psychopath.
