Proposal To Remove Transgender-Themed Materials Fails At Sumner County Library Board

After months of heated debate, the Sumner County Library Board rejected a proposal which would have pulled all materials related to transgenderism from county libraries, citing concerns about lack of legal guidance and potential lawsuits.

Introduced by Library Board Chair Joanna Daniels, the measure targeted all transgender and gender confusing materials, including any “subjecting, introducing, condoning, or encouraging a minor to identify with, or live as, a purported identity inconsistent with his or her biological sex at birth.”

The same standard would have been applied to materials for persons age 18 and older.

“It’s to get the libraries back in order, into a conservative viewpoint and to clean them up,” Daniels said at the meeting. “There is a community outpouring in support of this policy.”

When pressed by other board members about whether she had consulted the county attorney on the proposal, Daniels responded it was not necessary as, The argument that I should have got the yes or no from a law director is ridiculous, because we have the authority.”

When other members continued to harp on the need for the attorney to have signed off on the measure Daniels relayed that she had sent it and the attorney, while not offering an opinion on the proposal itself, said it looked “fine” legally. 

She also maintained throughout the back and forth that the board retains the authority to determine what materials are included or removed from library shelves and that policy is often created without the review of legal counsel. Several members reiterated they did not feel comfortable voting on such a measure without formal legal input.

Ultimately the board voted 4-3 against the proposal with one abstention. Multiple Pride flags were displayed by community members in attendance, and a man was heard shouting, “Oh my God, lady!” after one of Daniels’ statements.

It is unknown at this time if Daniels will attempt to revive the proposal or seek further legal advice on the issue and if some of the hesitant board members will change their votes should she do so.

  1. They need to replace those who voted against the proposal. The legal advice argument is just a tactic. Surely a library board has the right to remove books.

  2. Transgender people are just as much a part of the fabric of American society as anyone else. They have library cards and deserve to be able to check out materials that speak to their issues. LIBRARIES ARE FOR EVERYONE.
