The Tennessee Conservative [By Olivia Lupia] –
The Federation for American Immigration Reform (FAIR) has sent their latest investigative report exposing how certain progressive prosecutors are creating a two-tiered justice system favoring illegal aliens to 22 state Attorneys General, including Tennessee’s, calling on them to review and take legal action against certain “unconstitutional and anti-American” prosecution policies.
While the FAIR letter was primarily aimed at sanctuary jurisdictions with notoriously lenient prosecution practices for illegal immigrants like Colorado, Washington, New York, and Michigan, they also contacted AGs of states with “robust anti-sanctuary laws” which could be vulnerable to covert adoption of “immigration neutral” prosecution policies. Those states are Tennessee, Florida, Texas, Iowa, Oklahoma, Georgia, Alabama, South Carolina, Arkansas, Kansas, Idaho, South Dakota, North Dakota, and Wyoming.
The report is published by FAIR’s supporting organization, the Immigration Reform Law Institute (IRLI), and details how progressive prosecutors “deliberately offer lenient charges, plea, deals, and sentences to non-citizen defendants solely to shield them from deportation- practices that blatantly violate the Fourteenth Amendment’s guarantee of equal protection under the law, as well as analogous provisions in state constitutions.”
IRLI found through extensive research of public records, policies, and case outcomes the worst offending jurisdictions included Brooklyn and Westchester County in New York; Portland, Oregon; Boulder and Denver in Colorado; Ann Arbor, Michigan; Los Angeles and San Francisco in California; Chicago, Illinois; Seattle, Washington; and Arlington County, Virgina.
“In these areas, prosecutors are instructed to prioritize ‘immigration-neutral’ outcomes for non-citizens- such as reduced charges or diversion programs- while denying similar leniency to U.S. citizens facing comparable offenses,” the IRLI press release reads.
The report’s analysis also asserts these relaxed policies are based in Soros-funded ideology that misuses Supreme Court precedents to justify undermining federal immigration enforcement and erode public safety by incentivizing illegal alien criminality.
IRLI’s director of investigations Mateo Forero stated, “The evidence we’ve uncovered shows a deliberate pattern of favoritism toward non-citizens in major cities, driven by ideologies that prioritize open borders over public safety. These practices have real victims. IRLI will continue our investigations, submitting public records request to reveal case data and outcomes as we press for action from national and state authorities.”
FAIR and IRLI are calling on the U.S Department of Justice and State Attorneys General to investigate and sue these jurisdictions under federal and state law to “end this anti-American discrimination”.
“These ‘immigration neutral’ policies are not only anti-American but blatantly unconstitutional, as they disadvantage U.S. citizens in the criminal justice system solely to protect illegal aliens from the consequences of their actions,” said Dale Wilcox, FAIR’s executive director and general counsel.
Christopher J. Hajec, acting executive director and general counsel of IRLI said, “We hope the Department of Justice and State Attorneys General, using our thorough and eye-opening report, launch their own investigations into these jurisdictions and take them to court to end such flagrantly unconstitutional policies. In America, when it comes to the serious matter of charging and prosecuting people for crimes, justice must be equal for all, not unequal for American citizens.”
