Bill Mandating Insurance Companies Cover Detransition Procedures To Become Tennessee Law

Legislation mandating insurance companies selling policies including coverage for medical gender transition procedures or services must also include coverage for de-transitioning will now become Tennessee law after the House took up the bill for a second time and agreed to Senate amendments adding more enforcement mechanisms and clarifying parameters.

Along with the coverage and policy requirements, HB0754 also requires gender clinics and insurance entities to report information regarding de-transition procedures to the Tennessee Department of Health.

Bill sponsors in both chambers have reiterated that the bill does not violate any HIPPA laws and amendments ensure that all information to be reported regarding de-transitioners would be in the form of clinical data with nothing identifiable back to specific individuals or providers.

HB0754 initially passed the House 70-21 but was revisited by lawmakers on Wednesday after the Senate passed their version, SB0676, which included amendments allowing the state Attorney General to investigate any potential violations and clarifying what data is to be collected.

The House adopted the Senate amendments 73-21 along party lines with Rep. Monty Fritts marking himself “Present Not Voting”.

Now having the same language in both versions of the bill, HB0754 will proceed to Gov. Lee’s desk for signature into law.
