Evolve Bank & Trust CEO Bob Hartheimer was arrested by the FBI last week on charges related to sexual exploitation of a minor according to court records.

The FBI confirmed it had executed an arrest warrant at the company’s headquarters in East Memphis, though a company spokesman made clear Hartheimer’s arrest had no connection to the bank’s operations.

Records show Hartheimer, 68, was booked into the Shelby County Department of Corrections on charges of sexual exploitation of a minor and distribution of obscene material, both of which are felonies.

In response, Evolve’s leadership team confirmed Hartheimer’s immediate termination by the Board of Directors and the company’s full cooperation in the investigation.

“We are in close contact with the U.S. Attorney’s office and have been assured that this is a personal matter and does not relate to the Bank or its operations in any way. That said, we have offered our full cooperation as they investigate,” the statement read. “Our team remains focused on serving customers, supporting employees, and delivering on our business objectives. We remain confident in the strength of our leadership, the stability of our operations, and the continued trust of our customers and investors.”

Hartheimer is scheduled to appear in federal court in Memphis on Tuesday, Oct. 28. The case is currently under seal, and further details about the allegations are currently unavailable.

Formerly a senior official for several investment and financial technology (fintech) firms, Hartheimer was announced as Evolve’s CEO in August of 2025. He also helped create the Division of Resolutions for the Federal Deposit Insurance Company (FDIC) to analyze and sell failed banks.

Evolve has supposedly been under federal oversight for over a year after a data breach and federal regulatory actions tied to its fintech partnerships.
