City of Sevierville Files Lawsuit Against Business Over Height of Pole With American Flag

The City of Sevierville, Tennessee has taken its zoning dispute with Camping World RV Sales to a new level concerning a 130-foot pole that features a 3200 square foot American Flag.

The city is asking the Chancery Court of Sevier County to impose a $50 per day fine for a zoning violation because the pole exceeds the 44-foot maximum limit.

The Sevierville business had earlier requested a variance from the local Board of Zoning Appeals (BZA) for the length of the flagpole, but it was denied on February 1, 2024, at their regular meeting. The suit alleges that defendant Camping World did not appeal against the decision but proceeded with the flag installation anyway.

Sevierville is not only seeking a $50 per day fine but is asking the Chancery Court for injunctive relief to force the business to comply with the 44-foot height limit that is described in its zoning ordinance.

The suit lists the date of March 5, 2025, as the beginning date for which the daily fine commenced, the same date that a citation was hand delivered to Camping world by local police officers.
