Mother Of Special Needs Student Sues MNPS For Negligence After Son Suffers Brain Injury At School

A Metro Nashville Public Schools parent is suing the district, alleging negligence after her child, who has autism, reportedly sustained a brain injury while at Granbery Elementary School in 2023.

Shanikka Sherrill says her 7-year-old son Jayce Middlebrooks returned home from school on October 16, 2023, with visible bruising on his face and knots on his head. He was having a hard time staying awake. Jayce was diagnosed with a concussion.

Because she had not received any communication regarding the injuries, Sherrill questioned the school and was initially informed that her child had been injured while self-harming. No accident report was filed until after Sherrill contacted them. 

However, after further investigation was requested, Sherrill says she was informed by the principal that her child was kicked in the head by another student, and the injury was not reported by a teacher nor was he seen by the school nurse.

According to Sherrill, her son’s Individualized Education Plan states that he should have a one-on-one aide at all times.

Sherrill transferred her son to another Metro school but says negligence was still an issue there, alleging that he was able to access some kind of chemical agent and sprayed it in his face. She says it took a month to receive an accident report for that incident.

Jayce now attends a private school that specializes in working with children with special needs.

Sherrill says both incidents show negligence on the part of MNPS staff members. She is seeking $300,000 in damages.
