A Tennessee County Court is officially promoting Pride Month.
Davidson County Probate Judge Andra Hedrick of the Seventh Circuit Court presides over all matters filed in the Probate Court including adult and minor name changes, and “in observance of Pride Month” will be overseeing a mass name change for LGBTQ adults.
According to their website, a legal name change docket on June 28th at 1:30 PM has been scheduled specifically in recognition of Pride Month and is open to adults residing in Davidson County.
The name change petition and instructions from the court has the Pride Flag colors prominently displayed at the top of the first page.
Gender dysphoric individuals, or those who do not wish to conform to the gender they were born with, often opt to legally change their names in order to more closely align with their imagined gender as part of their LGBTQ journey.
In filling out the petition, LGBTQ adults wanting to change their given names must affirm that they have not been convicted of first or second degree murder, or any offense which placed them on the Tennessee Sexual Offender and Violent Sexual Offender list. In addition, they also must swear, affirm, and make oath before a notary public or the Probate Court Clerk that the intent of the legal name is not to defraud or mislead, that it will not cause injury to any individual or compromise public safety, and that it is being sought in good faith.
Once granted, those changing their names may then apply for a new state driver’s license in the new name, showing the court order as the reason for the change.
However, a new law that went into effect last July restricts the changing of gender markers on official identification documents such as driver’s licenses and birth certificates.
Carried by Representative Gino Bulso (R-Brentwood-District 61) and Senator Kerry Roberts (R-Springfield-District 23), the legislation provides a legal definition of “sex” to be used in all state codes and statutes. It defines “sex” as “a person’s immutable biological sex” and makes this definition the one to be used on all government-issued documents within the state.
Before 2023, those undergoing gender reassignment surgery were legally allowed to update gender markers on state-issued IDs by providing proof of the surgery.
