A bill that seeks to protect state sovereignty passed in the House Public Service Subcommittee in a 4 to 0 vote, with a lone Democrat lawmaker present but not voting, on Wednesday.
The legislation now moves on to the House State and Local Government Committee where it is scheduled to be heard on Wednesday, March 18th, 2026.
Sponsored by Representative Bud Hulsey (R-Kingsport-District 2), House Bill 2610 (HB2610), enacts the “Restoring State Sovereignty Through Nullification Act,” which establishes processes by which the Tennessee General Assembly may nullify an unconstitutional federal statute, regulation, agency order, or executive order.
Recognizing that the United States Congress is denied certain lawmaking powers by the First Amendment and that the U.S. Constitution also denies the federal government powers “not delegated to it,” conservative legislators have attempted to get the legislation passed for years.
The Senate bill (SB2657) has been placed on the Senate State and Local Government Committee calendar for Tuesday, March 17th, 2026.
