Unborn Child Protection Act To Be Considered In Tennessee House Subcommittee

The Unborn Child Protection Act of 2025, which would reaffirm that “human life begins at fertilization” and that “an unborn child is entitled to the full and equal protection of the laws that prohibit violence against any other person” has been scheduled for consideration in the House Population Health Subcommittee next week.

House Bill 26 (HB0026), sponsored by Rep. Gino Bulso (R-Brentwood-District 61), provides a strict liability, wrongful death cause of action, to anybody who is next of kin to an unborn child who is killed by abortion pills which are mailed into the state.

The bill’s language is based on pre-existing federal law that prohibits the mailing of abortion pills.

HB0026 would allow the next of kin to an unborn child who was the victim of abortion, to take civil action against the manufacturer, distributor, seller, or reseller of abortion-inducing drugs the caused the death of that unborn child.  

Under this legislation, the mother who took the abortion pills may also bring a civil case.

“Regardless of who actually kills the child, we want abortion pill manufacturers shut down from sending pills into the state,” Rep. Bulso previously explained“So the first time that they do that and they get popped with five million dollars […] maybe we’ll be able to stop them.”

According to the bill text, “A person or entity, including, but not limited to, a manufacturer, distributor, seller, or reseller, of an abortion-inducing drug shall not mail or deliver an abortion-inducing drug into this state.”

The legislation also reads that, “Notwithstanding another law to the contrary, a person or entity who mails or delivers an abortion-inducing drug into this state and the mailing or delivery results in the death of an unborn child is strictly liable in the amount of five million dollars ($5,000,000) in damages for the death of the unborn child.”

HB0026 has been placed on the calendar for consideration in the House Population Health Subcommittee for Tuesday, Feb. 18th, 2025.

  1. Everyone knew that abortion pills by mail would become a huge industry after the overturning of Roe v. Wade. Good luck trying to enforce your ban.
