Williamson County School District Sued For Allowing Biological Male To Attend Female Sex Ed Class

The Williamson County Board of Education, along with Legacy Middle School Principal Alicia Justice are being sued for allowing a biological male who identifies as a girl to attend a female sex education class earlier this year.

Filed in Williamson County Chancery Court, the lawsuit claims that the school violated a state law by allowing the boy to attend the state-required two-day Family Life session that the school promised would be segregated into boys and girls classes.

As part of the curriculum for the girls, the class presented information on the female reproductive system as well as other topics sensitive to being female. Because of the boy’s presence on May 15th, parents say that at least 13 of the female 7th-grade students felt uncomfortable and opted out of the class after the first day. Despite this, the boy was allowed to continue attending the class on May 16th.

According to the lawsuit, one parent emailed Justice to specifically ask if any boys or male staff would be attending the class for girls to which Justice replied that parents could opt out of the class.

Instead of addressing the parent’s concern, the lawsuit calls Justice’s response “a wholesale abdication of her duties to honor her April 11 commitment to segregate boys and girls during the lessons and to protect the privacy and emotional well-being of vulnerable 7th grade girls.” 

Justice “inexplicably prioritized allowing a male student to be present” without regard for the emotional distress of her female students.

One of plaintiffs wrote to Justice saying that they would continue to opt their daughter out of the class having “lost trust in the process.” 

The parent went on to say, “Many female students opted out after the first day of the presentation due to a male student being present in the room. The school continued to allow his attendance for the second day knowing full well how many of the girls felt about the situation. We are extremely disappointed in how the administration at Legacy Middle School handled this. In writing, it was stated that these particular health classes would be separated by gender and when we asked directly regarding this and if a male student was present we were not given an answer.”

The girls who opted out spent the class time in the school counselor’s office where instead of being welcomed they were greeted with disdain. According to details in the lawsuit, Kristin Trudeau’s body language and facial expressions communicated annoyance with the decision of the girls to not participate in the lessons.

Trudeau, founder of Franklin Teletherapy, offers counseling sessions that explore “sexual identity, polyamory, kink, consensual non-monogamy, and BDSM practices.” Her website advertises Trudeau as “an LGBTQIA+ advocate and ally” as well as a sex therapist who is supportive of “kink” and polyamorous relationships.

The Tennessee statute cited in the suit was sponsored by Representative Gino Bulso (R-Brentwood-District 61) who is legally representing the families. 

Under the law, the sex of a person is defined by biological anatomy and genetics at birth. However, when one of the 7th-grade girls asked Justice why the boy had been allowed to participate in the class, Justice referred to the boy using female pronouns, contrary to the law.

The lawsuit also claims that the defendants failed to enforce a second state law, the Tennessee Accommodations for All Children Act, by allowing a boy to use multi-occupancy restrooms for girls at Legacy. The numerous violations of the act were witnessed by many female students at the school, including the daughters of the plaintiffs.

According to the suit, “Although defendants’ reckless and intentional conduct caused emotional harm to the young ladies whose trust and innocence they betrayed, no claim is made here for economic or non-economic injury.” 

The lawsuit is looking for “appropriate declaratory and injunctive relief” so that the two laws will not be violated in the future.
