Wrongful Death Lawsuit Eligibility Bill No Longer Expands Definition Of Tennessee’s Unborn Children

The Tennessee Conservative [By Paula Gomes] –

A bill that seeks to amend Tennessee’s wrongful death statute is advancing in the House.

The legislation originally sought to expand the state’s definition of a person for whom a wrongful death action may be brought to include an unborn child from fertilization to birth.

Sponsored by Representative Gino Bulso (R-Brentwood-District 61), House Bill 1528 as amended passed in the House Judiciary Committee on Monday in a 15 to 3 vote and now heads to the Calendar and Rules Committee.

The legislation would extend the period after which a spouse is presumed to have abandoned or willfully withdrawn from a deceased spouse for purposes of bringing a wrongful death claim from two years to three.


The companion Senate Bill 1743, sponsored by Senator Janice Bowling (R-Tullahoma-District 16), is scheduled to be heard in the Senate Judiciary Committee today, March 24th, 2026.
