It’s PRIDE Month In Tennessee & Drag Performances In The Presence Of Minors Is Not Yet Settled, Despite Local Reports

As PRIDE Month kicks off with a flurry of PRIDE events across the state, culminating in what is arguably the largest of all the state-wide events, PRIDE Nashville, which is a 3 daylong event which includes a parade, pageants, and a “spirituality day lead by the Universal Unitarian Church of Nashville, there is yet to be a decision rendered by the 6th Circuit Court of Appeals, on whether the law passed in Tennessee in 2023 is unconstitutional. 

Many other news outlets in the state continue to inaccurately report on the ruling by a federal court in the Western District as settling the issue in Tennessee. 

However, final closing arguments were given to the federal 6th Circuit Court of Appeals who were hearing cases from both the state of Tennessee and Kentucky in tandem on February 2nd of this year and have yet to render a final decision on the matter. 

At the heart of the issue, is whether the state can determine what sort of entertainments are classified as in the language of Tennessee code, “adult cabaret performance”. 

In 2023, the Tennessee General Assembly passed a law SB0003, which did exactly this, causing those types of entertainments to be confined to spaces for those who are 18 and older, just like any other type of adult entertainment. 

The list of those who perform this kind of entertainment category now include: topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators. 

A troop of drag performers in Shelby County filed a lawsuit in June of 2023, and the Western District Court ruled that the law was unconstitutional based on the members 1st Amendment right to freedom of expression, to put it simply. 

Many critics assert that no one is questioning the plaintiff’s right to freedom of expression, but rather their right to do so in the presence of underage children. 

The litigation is on-going, and the 6th circuit Court of Appeals could render their verdict any day. However, the argument is far from settled in Tennessee. 

As it stands now, there is a long list of what could prove to be age-inappropriate performances and activities throughout the state of Tennessee.

Nashville Pride Turnabout, Friday, June 7 at Play Dance Bar, 1519 Church St., Nashville (7 p.m. – 10 p.m.)

Hendersonville Pride Picnic, Saturday, June 8 at Sanders Ferry Park, 547 Sanders Ferry Road, Hendersonville (beginning at 11:30 a.m.)

Pride Month Indie Artist Spotlight, Saturday, June 8 at Frankie J’s, 1314 6th Ave. N., Nashville (7 p.m. – 9 p.m.)

The Pink Pride Tour with RuPaul’s Drag Race’s Trixie Mattel, Saturday, June 8 at Cannery Hall, 1 Cannery Row, Nashville (beginning at 7:00 p.m.)

Clarksville Pride Festival, Saturday, June 29 at Wilma Rudolph Event Center, 1190 Cumberland Drive, Clarksville (11:00 a.m. – 9:00 p.m.)

Rutherford County Pride Celebration, June 29 at Oaklands Mansion, 901 North Maney Ave., Murfreesboro (10:00 a.m. – 8:00 p.m.)

This list is exclusive to Middle Tennessee. There will be many more throughout the rest of the state as the month progresses. As mentioned above, Nashville PRIDE parade will commence on June 22nd, and for the second year in a row, MurfreeFurs are being invited to be a part of the parade.

According to their website information page on the event details, this was included: “Theme? – …did you really just ask that? IT’S FRICKIN’ PRIDE! Pup hoods ARE allowed at this event exclusively, along with fursuits!” 

The Tennessee Conservative did more extensive reporting on exactly what Pup Play is, and what it looks like, but essentially it is a form of BDSM that incorporates hoods and collars with chains attached, so those who participate can pretend they are “pups” while engaging in sexual activity.

Recently, The Tennessee Conservative reported on the  Chattanooga Youth Pride Day event which took place on Saturday, June 1st,  and featured “a stage set up for live performances by talented LGBTQ+ youth artists, including singers, dancers, poets, and drag performers. The performances showcase the diversity and creativity of the community, while spreading messages of love, acceptance, and pride.”

Attorney General Jonathan Skrmetti has previously advised that despite the injunction rulings from the 6th District, state law regarding drag performances in the presence of minors is still fully effective in all other 93 counties in Tennessee. 

However, due to the lack of a decision in the ongoing case, there is not a single district attorney in the state who is seemingly willing to prosecute a case until the verdict from the court is rendered. 

It is very likely that whatever that verdict is, it will be appealed again, and this time it would go to the Supreme Court for their consideration. 

It is also possible that in this an election year, and a particularly pivotal election year at that, the court may be concerned with who will be in the White House come fall, and if their decision will be affected by America’s choice on November 5th

  1. NO, It is not PRIDE MONTH in TN. but DISGRACE month in America. These parents that scream and protest that the government CANNOT DICTATE LAWS for there children better wake up and realize it already does. You are REQUIRED to educate, put them in car seats and safety belts, provide childcare so they are not left at home without adult supervision, they need permission for a tattoo, etc. True, a government cannot legislate morality but it CAN dictate IMMORALITY. HOW WILL THE GREAT IAM JUDGE YOU?? YES, WE WILL ALL BE JUDGED.

Unfortunately, we live in a sick culture when people can justify, even boast (pride) about this type behavior in public settings. It is not free speech, it is the deception of an evil spiritual world, putting wool over the eyes of many!
