Memphis Gynecologist Charged With Sex Crimes & Medical Misconduct Reindicted With 46 New Charges

After having 17 of the original 36 charges of sex crimes, medical misconduct, and healthcare fraud dismissed last month, Memphis gynecologist Dr. Sanjeev Kumar has been reindicted on 46 new charges in addition to the 19 remaining counts from the first indictment.

Kumar’s Poplar Avenue Clinic Women’s Health and Med Spa was raided in 2024, leading to his 2025 indictment on 36 federal counts including performing unnecessary procedures, reusing disposable materials, fraudulently billing Medicare and Medicaid, and enticing individuals across state lines for illicit sexual activity.

The doctor’s defense filed three motions for dismissal, arguing several of the sexual misconduct charges were invalid because the actions were not done in pursuit of “libidinal gratification” and that the thousands of individual acts of misbranding equipment over months or years were improperly combined into single charges.

Two of the petitions were granted on these technicalities, resulting in 17 of the 36 charges being tossed by a federal judge last month. The 17 dismissed charges included 4 counts of enticement and inducement to travel to engage in illegal sex acts, 5 counts of adulteration of single-use medical devices, 5 counts of misbranding reprocessed single-use devices, and one count of adulteration of hysteroscopes cleared for reprocessing.

A third motion seeking to dismiss the health care fraud charges was denied, as was the petition for a change of venue for the trial. Under the judge’s orders, Kumar was allowed to resume operations at his practice using multi-use devices during procedures, chaperoned office exams, and a prohibition on examining minors unless authorized by the courts to do so.

But on Oct. 30, the federal government levied 46 new counts against Kumar, claiming that between Sept. 2019 and April 2024, Kumar “engaged in a series of crimes, frauds, and other acts that abused the trust of both the Medicare and Medicaid programs, and his patients.”

According to this newest indictment, Kumar faces the following charges:

  • 16 counts of Adulteration of Single-Use Devices
  • 16 counts of Misbranding of Reprocessed Single-Use Devices
  • 4 counts of Adulteration of Hysteroscopes Cleared for Reprocessing
  • 10 counts of Health Care Fraud (for performing unnecessary procedures)

Kumar is set to be arraigned on the new counts on Tuesday, Nov. 4, and his federal trial is scheduled to begin Dec.1. Should he be convicted on all counts, the doctor faces a maximum of 20 years in prison, a $250,000 fine, and supervised release of several years.
