Representative Jody Barrett Speaks Out On Halted Inmate Execution, Urges Legislature To Reconsider Transparency Bill

State Representative Jody Barrett (R-Dickson-District 69) said last week’s halted execution attempt in Tennessee demonstrates why the public deserves greater transparency and accountability surrounding the state’s lethal injection process. 

“The incident reinforces the need for HB2168, legislation sponsored to increase transparency surrounding Tennessee’s execution protocols while still protecting the identities of individuals directly involved in carrying out executions. Tennessee has a responsibility to ensure that if the state carries out the ultimate punishment, it is done competently, lawfully, and with accountability to the public. This week’s failed execution attempt raises serious questions, and Tennesseans deserve honest answers.” – said Representative Jody Barrett

House Bill 2168 would increase transparency surrounding Tennessee’s execution protocols. 

Under current Tennessee law, nearly all records related to execution procedures and suppliers are shielded from public inspection. Barrett’s legislation would clarify that suppliers involved in manufacturing, compounding, or distributing lethal injection drugs are subject to public disclosure requirements, while continuing to protect personally identifiable information and the names of individuals directly carrying out executions.

The legislation would also make financial records related to execution contractors and suppliers available for public inspection, including payments made in connection with executions, and would require certain financial reporting to the state comptroller.

Barrett’s proposed legislation was taken off notice in the House Public Service Subcommittee of State and Local Government on March 18, 2026. The bipartisan bill was co-sponsored by Representative Gabby Salinas (D-Memphis). The companion senate bill was sponsored by Senator Mark Pody (R-Lebanon) and co-sponsored by Senators Raumesh Akbari (D-Memphis) and Heidi Campbell (D-Nashville).

Barrett said, “This bill was carefully written to strike a balance. The identities of individuals directly involved in carrying out executions would remain protected, but taxpayers should still know who the state is contracting with, how public money is being spent, and whether proper procedures are being followed.”

His recommendations for improving legislation come in the wake of the attempted execution of a death row inmate. Tennessee officials halted the scheduled execution of death row inmate Tony Carruthers after medical personnel were unable to establish IV access necessary to carry out the lethal injection procedure. Governor Bill Lee later issued a temporary reprieve.
