A rollover bill from last year which would officially declare that the state only recognizes two sexes is set to be heard in the House Judiciary Committee on Wednesday, January 21.

HB1271, by Rep. Mark Cochran (R-Englewood-District 23), simply states, “It is the policy of this state that there are only two (2) sexes, a biological male and a biological female.”
Previously, Rep. Cochran noted that the legislature had already defined “sex” as male and female and this proposal would provide an enforcement mechanism to ensure all state agencies are using that definition when creating public policy. The legislation is applicable to government agencies, not individuals.
And Sen. Paul Rose (R-Lauderdale-District 32), who is carrying the Senate version SB0936, explained how the bill works in concert with President Trump’s Executive Order regarding gender ideology and restoring biological truth.
According to Rose, the requirements of the legislation will mandate all local and state government entities must revise existing references to sex or gender to align with sex as defined in state law, and after the law takes effect, entities cannot adopt any policies or rules using a different definition.

Additionally, Tennessee residents can file complaints in chancery court if they believe a local government entity is non-compliant, and courts may issue a writ of mandamus to enforce compliance and impose penalties, including barring the entity from entering grant contracts with the Department of Economic and Community Development.
Residents may also report non-compliance of state government entities to the comptroller of the treasury. Those found to be out of compliance risk financial penalties including the withholding of general fund revenue and loss of grant eligibility.
SB0936 passed the full committee process last year but was stalled before making it to the full Senate floor, likely because it was deferred in the House until the second calendar of this year.
Should the bill pass both chambers of the legislature, it will take effect immediately upon becoming law.
