While Nashville District Attorney General Glenn Funk claimed that a March search of his officers was by his “invitation,” new sources reveal that it was actually a raid by the Tennessee Bureau of Investigation that was authorized by a search warrant.

According to information released by NewsChannel 5 Investigates, Davidson County Criminal Court Judge Cheryl Blackburn issued the search warrant for the March 24th search.

In order to obtain a search warrant, TBI officials would have had to prove to the judge that they had probable cause to believe that Funk had committed a crime and that evidence would be found in the search area.

Funk has been accused of a number of counts of alleged misconduct in recent months, with the most recent investigation looking for evidence of cameras equipped with microphones that could potentially violate federal and state laws about wiretapping.

TBI agents spent the day and much of the night searching through the DA’s offices, finally leaving around 3 a.m. on March 25th. Agents were seen using a device that the manufacturer says is “designed to detect illicit eavesdropping signals.”

Currently, Judge Blackburn has all records sealed, possibly at the request of Tennessee Attorney General Jonathan Skrmetti. Both NewsChannel 5 and Funk have filed a request to have the records pertaining to the warrant opened to the public.

Funk maintains that he “extended an invitation to the TBI and the Attorney General’s Office several weeks ago to come inspect our office security system.”

Funk also threatens Skrmetti in the motion, stating, “Thus, it is absolutely necessary to open the instant file and affidavit because it directly affects whether General Funk has an obligation to report the Attorney General to the Board of Professional Responsibility.”

He claims that the investigation by Skrmetti’s office is a conflict of interest because a former employee who worked for Funk until last summer is now employed by the unit who is leading the investigation and because the attorney general’s office is also serving as counsel for Funk in several cases.

Funk continues to state that he and his employees are not guilty of any wrongdoing in any of the alleged misconduct.

Looks like someone has it in for this guy. If there’s proof of illegal actions or not, there is no reason to hide the results. I hate these trials by innuendo.
