Firearms Rights Advocacy Groups Sue Memphis Over Gun Referendum

The Tennessee Conservative Staff –

The Gun Owners of America, along with the Gun Owners Foundation and the Tennessee Firearms Association, filed a lawsuit on Wednesday against the City of Memphis, stating that the gun control referenda is “in direct opposition to the state’s robust preemption law.”

Erich Pratt, Senior Vice President of GOA stated, “Tennessee has one of the strongest preemption laws in the nation, and the very reason it exists is to prevent radical anti-gun cities from enacting the very sort of draconian policies Memphis just ‘adopted.’ We are hopeful that Tennessee Courts will quickly block this insubordinate violation of state law.”

The three measures proposed on the referendum included: requiring permits to own handguns, restricting assault weapons within city limits, and establishing a “red flag” law. More than 80% of voters in Memphis supported the referenda.

Despite the support from voters, there is a strong change that the proposals will not ever go into effect because of existing state laws that currently override them.

Some Memphis city council members have claimed that gun rights advocates are “afraid that we could set a precedent about allowing large cities to have some sort of reasonable gun regulation” and have called on state legislators to meet with them regarding the possibility of an exemption from state gun laws for the city specifically.

“I’m sure that you’ll be hearing from a lot of us going to Nashville and wanting to talk to our colleagues up there and get their advice, and try to see if we can get their help to come up with something that makes sense for the whole state,” City Councilman Jeff Warren said.

Republican state Senator Brent Taylor of Memphis dismissed the idea, saying, “The City Council misled the public. They committed fraud against Memphians….Those referendums were, again, as meaningless as a nutrition chart on a bag of ice.”
