The Putnam County Commission unanimously voted to approve a resolution on Monday that asks the Tennessee Legislature to put a halt to any potential “red flag” gun laws.
Red flag laws allow state courts to temporarily take firearms from an individual who is determined to be a threat to themselves or to others. This includes some who have been convicted of crimes, as well as those deemed mentally ill.
The resolution was proposed by District 7 Commissioner A.J. Donadio. Donadio noted that some people wanted to know how this new resolution was different from one passed in May 2020 that was passed to show support for the U.S. Constitution in its entirety.
“The facts have changed in that, in Nashville on Aug. 21, you’re going to be having the legislature come for a special session where they’re going to be considering red flag laws in the state of Tennessee,” said Donadio.
Donadio says those kinds of laws are a violation of the 14th Amendment’s “due process” clause in the Constitution.
“If you’re convicted of certain crimes, your Second Amendment rights can be taken from you,” said Donadio. “Red flag laws reduce that to an accusation – without due process, and that cannot be tolerated.”
Many other counties across the state have also approved resolutions expressing their opposition to any laws that would infringe upon the Second Amendment rights of Tennesseans, including but not limited to Jefferson, Williamson, McMinn, Lewis, Grainger, Carter, Benton, Wilson, Loudon and Sullivan counties.
