Referendum On Gun Control May Be Delayed Until November In Memphis

A referendum on gun control that was originally supposed to be on the August 2024 ballot in Memphis may be delayed until November. 

Last year, the city council voted to add a referendum to the ballot that asked three questions of voters:

• Does someone need a permit to carry a gun, and how should it be stored in a car?

• Should there be a ban on future assault weapon sales, and restrict the use of assault weapons already in circulation?

• Should there be a red flag law, where law enforcement could take away a gun if someone is considered to be a risk?

The fate of other city charter amendments are also undecided.

According to Shelby County Elections Coordinator Linda Phillips, the ballot questions on gun control and another question regarding a requirement that mayoral candidates live in the city for two years, were not received in time to be added to the August ballot.

At a council meeting last week, a vote was not taken on moving the referendums. 

If added to the November ballot, the gun control questions would be seen by more than half of the county’s voters as the presidential general election is the most popular in Shelby county according to voter turnout statistics. Four years ago, the August election cycle saw just 19.1% of voters turn up to vote.

At the end of May, Governor Bill Lee signed legislation that prevents cities and municipalities in Tennessee from creating or enforcing red flag gun laws.

Carried by State Senator Janice Bowling (R-Tullahoma-District 16) and State Representative Jody Barrett (R-Dickson-District 69), the new law preempts “the entire field of legislation regarding extreme risk protection orders (ERPOs) to the exclusion of all county, city, town, municipality, or metropolitan government law, ordinances, resolutions, enactments or regulation.”

Also know as “red flag gun laws,” ERPOs allow courts to seize firearms from an individual who is considered a potential threat either to themselves or others.

The bill’s sponsors stated that the legislation was necessary to protect Tennesseans from possible governmental overreach in the area of gun control. However, opponents argued that local governments should be allowed to decide for themselves depending on their own needs.

    ” Restrict the use of assault weapons already in circulation”. This question doesn’t make any sense. The majority of crime in Memphis is committed by one particular group of citizens. How about just banning the use of weapons by that specific group? But that would be racist. Right? (Need an eye-rolling_ emoji.

      YOU are right on the money and also in NASHVILLE, all you have to do is watch FOX news at night to see what group is shooting people and robbing them. BUT you will never here them say what group it is.

    Even the head of the ATF could not define what an assault weapon is.
    There are now 25,000 +- sensible firearms regulations on the books.
    If they really care about taking firearms off the streets, visit the projects for a starter, then go after the drug dealers and terrorist street gangs.
    Maybe the fools just want to make it easier for criminals to ply their trade.

    The Libs are sooo stupid. Memphis should encourage people to carry concealed – that would discourage murders in the Murder Capitol of the U.S.

    Seriously > a warning to all conservatives > do NOT go to Memphis unless you must and if you go, take a gun and watch your back – they will sneak up behind you and shoot you in the back of the head. In 2018 the President of the Memphis Chamber was murdered that way – Google it if you doubt it.

      I watch all this GUN control crap and think do they ever take a look a who is doing all the shootings, and I know they do, but do not have the nerve to say what group of people it is.

    Can you lose your right to a trial by jury for drunk driving, if Governments have the authority to deny one of your “Bill of Rights” they have authority to deny “ALL OF YOUR RIGHTS”.

    Under Tennessee law you can lose your Second Amendment right for drunk driving.

    Under the present system conviction of any crime is justification to deny you all your rights, or which every right they want to deny you, Second Amendment in most case, but it could even be a trial by jury if “THEY CHOSE”, just lock you up throw away the key.

    But in coming after people’s “Bill of Rights” they have to attack the whole “FEDERALIST” system on which the Constitution is based, taking authority they were denied and never enumerated, cross boundaries that restrict them to their respective departments, and worse of all “LYING TO THE CITIZENS”.

    We have guns to protect our Constitution and Freedoms, but few people have the guts to use them, even if they did, “IGNORANT CITIZENS” on juries would find them guilty of what the Constitution authorizes them to do with their Guns,

    You see our problem isn’t so much the RINO Politicians, it’s the “IGNORANCE” Citizens have of what the Constitution and law,

    NO LAW is worth anything if Government can’t get a “JURY” to convict someone of that law.

    and most Citizens don’t know they have this “NULLIFYING” power in their hands

    WELL said our government does not want its people to be able to defend there own lives. IF the 2nd AMENDMENT falls you can bet the FIRTS will be next, it is already under assault. NO gun law they have gotten passed in the last 30 years could stand up under our CONSTITUTION. THE ATF breaks the law every day, and BIDEN is counting on the ANTI GUN and CLIMATE change nut jobs to pass more gun laws. NEVER give up any of your RIGHTS good men have died to secure for you.
