Tennessee Immigration Bills Dealing With Local & State Agencies Advance In House

Three immigration bills dealing with various local and state agencies continue to advance after being heard in the House Departments & Agencies Subcommittee on Tuesday.

All three pieces of legislation passed the subcommittee along party lines and have been referred to the House State and Local Government Committee.

House Bill 1710 (HB1710), which would require local government entities to run citizenship checks on applicants seeking state-funded benefits has a fiscal note of $131,100 for the first year and $127,900 every year thereafter.

House Bill 1711 (HB1711), as amended, requires the names of illegal aliens to be reported by various public entities which would include school districts and institutions of higher education, prisons, healthcare providers, and social services unless doing so conflicts with federal laws such as the Health Insurance Portability and Accountability Act (HIPAA). 

The bill also mandates annual reports on the costs incurred by the state for educating the children of illegal aliens among other public benefits received.

Sponsored by Representative Johnny Garrett (R-Goodlettsville-District 45), House Bill 2219 (HB2219), as amended, would mandate that all city and county law enforcement agencies enter into agreements with the 287(g) program which allows certified officers to identify and process removable aliens, place immigration detainers and initiate removal proceedings, and then ensure transfer to ICE.

Agencies that do not enter into such agreements could have state funds withheld.
