Bradley County Parents Notified Of Statewide Mask Mandates For Tennessee Head Starts

Last week, December 2nd, Bradley County parents and guardians received a letter from the Family Resource Agency notifying them of the new regulation from the Federal Office of Head Start (OHS) that anyone 2 years of age or older must wear facemasks when inside with others.

All Federally-funded head starts in Tennessee will be facing the same regulation.

The letter from Paula Bacon, CEO of Family Resource Agency Inc., states that after President Biden released his plan for the vaccine mandate, the OHS developed new regulations to “reduce and prevent the spread of Covid 19 even further than the actions we have taken over the past year and a half.”

Bacon states that they recently participated in a webinar with the Director of the OHS in which the new regulation was presented that went into effect on November 30th.  

The regulation outlined reads as follows:

  • Anyone 2 years and older (children through adults) must wear facemasks while inside with others.  Masks for children won’t be required at nap time or during drinking and meals.  There are some exceptions for medical reasons that can be approved, if necessary.

Bacon states that due to the short notice of the new regulation, the Family Resource Agency was not prepared with enough masks for all the children.  She states that orders for masks may take at least two weeks to arrive and taking Christmas break into account, the mask requirement will not begin until classes resume in January.

In the letter, Bacon notes that Governor Lee recently signed laws that prevent required vaccinations, proof of vaccination and mask mandates.

However, the OHS states that “the Supremacy Clause of the U.S. Constitution regulation preempts any state law under US Constitution, Article VI 2.”

Bacon states that in order for Tennessee head starts to continue to receive federal funding for Early Head Start, Head Start and Child Care Partnership Programs, they must comply with the new regulations.

The regulations have been put in the Federal Registry for a comment period effective November 30th that allows the community to address concerns regarding any changes.  After the 30-day comment period, the Office of Head Start claims they will review the comments and determine if changes should be made to the new regulations.

In a previous article by The Tennessee Conservative, we outlined the exemptions to the regulation which the OHS states applies only to a “narrow subset of individuals who cannot wear a mask or cannot wear a mask safely” are those individuals with a disability as defined by the Americans with Disabilities Act (ADA) or children with special health care needs.

  1. Yet more evidence that Americans MUST return to self-sufficiency and stop accepting Federal Government handouts for food, medical care, education, childcare and any other social welfare program. Anything the Government gives it can regulate and deny access. Federal Social Welfare programs are nothing more than a scheme to buy votes. Governments are NEVER truly compassionate just controlling! Governor Bill Lee must grow a spine, stand up against the Federal Government and educate the citizenry of Tennessee of the individual perils of accepting Federal handouts. This is what a real conservative would do.

    1. Gov Lee appears to be a liberal or maybe a rino. I hope we can get him out office in the next election.

  2. I agree with David Faulkner, red states need to divorce themselves from federal monies, and federal control by exercising their tenth amendment rights. I just read the supremacy clause in article VI -2 of the US Constitution, and my interpretation is this reasoning may apply if these mandates were actual law passed by both chambers of congress and then signed by the president. Here is article VI -2.

    This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, anything in the Constitution or Laws of any State to the Contrary notwithstanding.

  3. The Supremacy Clause applies to ONLY A FEW AREAS, NOT ANY AND ALL that they want to dominate. Specifically, things like interstate commerce, treatise and taxation. But NEVER health matters. That is reserved for the states. DO NOT COMPLY.

  4. That is a load of garbage. It is time to say that’s enough. Pull kids out. No children, No Funding, Law suit.

  5. SHAME ON THEM! IT ALL BOILS DOWN TO THE DOLLAR AND NOT THE WELL-BEING OF THE HUMAN BEING! PARENTS REMOVE YOUR CHILDREN AND LET THEM SIT THERE ON THEIR DOLLARS!

  6. This is absolutely ridiculous for a 3 or 4 year old to have to wear a mask… This will only cause more sickness because of how kids touch everything, but my children who are in Head start will not be returning until this mandate goes away. My younger children also will not attend Head Start with how this was handled.
    I am truly disappointed!
