Senate Committee Kills Bill To Protect Tennessee’s Sovereignty

A bill that would restore state sovereignty in Tennessee failed in the Senate State and Local Government Committee on Tuesday.

Senator Janice Bowling (R-Tullahoma-District 16), the sponsor of Senate Bill 1092 (SB1092), introduced the bill and provided an explanation to the committee. She noted that the nullification process is not a new procedure, but the new legislation would provide an “orderly pathway for the state to use the nullification process.”

Bowling gave extensive historical context, citing several instances where the nullification process had been alluded to or used in the past.

As she was preparing to complete her speech, Chairman Richard Briggs (R-Knoxville-District 7) recommended that they go ahead and move along with the bill. 

Senator Mark Pody (R-Lebanon-District 17) made a motion on the bill, but there was no second. 

Briggs noted that because there was no second on the bill, it failed.

He did provide explanation, stating that it would be a good potential bill for the summer session because it would require witnesses and lawyers and several days to deal with all of the issues but also noted that it was an interesting legal topic.

The companion bill was scheduled to be heard in the House State Government Committee on Wednesday but with the bill already dead in the Senate, the legislation cannot progress further this session.

While Briggs has previously related to us that the chair of a committee cannot offer a motion for a bill to move forward, earlier in yesterday’s meeting he offered a motion to move a bill forward, that was then seconded.

All committee members were present at yesterday’s meeting but only Senator Pody offered support for Bowling’s bill.

  1. Once again, the RINOs show their true colors. They are loyal only to their PACs, federal overlords, and of course, the almighty dollar. They could not care less about state sovereignty, their constituents desires, or their oath to preserve the maximum amount of freedom for the individual citizen that they claim to represent.
