Tennessee Attorney General Files Complaint Against DHS, ICE For Failure To Produce Requested Documents Regarding Plans To Release Immigrant Detainees Into State

The Tennessee Attorney General’s Office filed a complaint against the Department of Homeland Security (“DHS”) and the United States Immigration and Customs Enforcement (“ICE”). The complaint raises claims under the Freedom of Information Act (“FOIA”) stemming from Defendants’ failure to produce documents regarding the release of immigrant detainees into Tennessee.

“Tennesseans have a right to know what the federal government is doing in Tennessee. ICE’s rejection of transparency is all the more troubling because of the humanitarian crisis resulting from ICE’s misdirected priorities,” said Attorney General Jonathan Skrmetti. “No federal official is exempt from public accountability.”

In late 2022, Tennessee learned that ICE planned to transport potentially thousands of single adult noncitizen detainees from ICE detention facilities in Louisiana and release them into Tennessee pending final removal proceedings.

ICE officials, the State learned, had been cooperating with Tennessee-based organizations and municipal employees to carry out the release plan.

Tennessee subsequently submitted a series of FOIA requests to ICE seeking records and third-party communications about the Biden Administration’s plan and any detainee releases into Tennessee. However, ICE has not produced a single document.

Tennessee had no choice but to file suit so that the people of Tennessee can learn the scope of detainee releases and evaluate the resources necessary to respond.

  1. It’s not safe for Tennessee to bring in an all male army to infiltrate. many of who are criminals . Please reject this now, or transfer them to the border. We have laws that state they be deported if they break in. No honest person would break into a country where they don’t belong. Pleas do not put the public in danger of these unwanted men. Our life is in your hands.*-

  2. We can’t allow the lawlessness that pervades California to occur here. Breaking zoning laws, business licenses and laws, hit & Runs, refusal of Government to enforce on immigrants because there’s no money in it.

    To quote Victor Davis Hansen: “Tribalism, not the melting-pot, is California’s paradigm. . Thousands of break-ins yearly, vandalism, hit-and-run accidents, drug manufacture and distribution, and public schools and hospitals that are overflowing with clients who speak little English and have little capital, but expect instantaneous American-style service.“- A recent refugee from California, trying to be a good Tennessean.

    We left the 3rd world-country called California a few years ago for the same reasons.
    Good for our TN Attorney General who filed a complaint against DHS, ICE for failure to produce requested documents regarding plans to Release Immigrant Detainees Into TN.

  4. I’m planning my escape from California and will do ALL in my power to prevent TN from falling victim to the insanity and sheer lawlessness that is so pervasive here! Do NOT allow this invasion from our border of ILLEGALS to stay one day in TN! To do so would be giving permission for them to destroy what you have built! I’ve seen it happen here in Ca and I’ll be damned if I’ll allow it to happen to TN! Stand STRONG Tennessee! DEFEND Your RIGHTS .. the invaders, as ILLEGALS have NONE! Don’t forget that! Do NOT give them “services”, do NOT give them “benefits”, do NOT ‘give’ them Anything but a ONE-WAY ticket OUT … send them to DC or Back to the border! But make sure they understand that they are NOT welcome in TN! I will actively fight this WITH you!
