Tennessee Bill Challenging Supreme Court’s Ruling On LGBT Protected Classes To Be Heard By House Subcommittee

A bill by Rep. Gino Bulso (R-Brentwood-District 61) intending to challenge a Supreme Court ruling making sexual orientation and other LGBT ideologies protected classes under discrimination laws is headed to the House Civil Justice Subcommittee on Wednesday, Feb. 11.

Titled the “Banning Bostock Act”, HB1472 seeks to exclude sexual orientation, gender identity, and abortion related acts from the definition of sex-based discrimination while still protecting the creation and enforcement sex-segregated spaces like restrooms, locker rooms, shower facilities, changing areas, dormitories, or sports teams. 

The legislation would stand as a direct challenge to the 2020 Supreme Court decision in Bostock v. Clayton County, Georgia where the Court ruled the above categories were to be included in sex discrimination protections.

“I wanted to make sure that the courts understood that in Tennessee, in our statutes and our discrimination statutes, including the Tennessee Human Rights Act, when we have used the term “sex,” we meant sex: male or female. It doesn’t include sexual orientation and gender identity,” Bulso has said of the bill. 

“There’s confusion in the courts over a lot of issues, and that’s why it’s important to bring these bills in Tennessee,” Bulso added. “When you have a federal court interpreting a federal statute, there’s always a danger that a state court judge may interpret a state law the same way. Bostock is the perfect example.”

HB1472 is one of several LGBT issue-focused bills Bulso is sponsoring this session, aiming to challenge special classifications, recognition of same-sex marriages, and banning Pride flags on state property.

The Senate companion, SB1745, is sponsored by Sen. Janice Bowling (R-Tullahoma-District 16) and has yet to be placed on the calendar for the Senate Judiciary Committee.
