Tennessee House Subcommittee Advances Bill Preventing AI From Impersonating Mental Health Professionals

On Tuesday, the House Population Health Subcommittee unanimously passed a bill which would restrict artificial intelligence (AI) systems from being advertised as mental health professionals.

HB1470 simply prohibits a developer or deployer of an AI system from advertising the AI as a “qualified mental health professional” to the public. 

A violation would constitute an infringement of the Tennessee Consumer Protection Act of 1977 as it would be considered an “unfair or deceptive act or practice affecting trade or commerce,” and could also be subject to an additional civil penalty of $5,000 per incident. 

The House Population Health Subcommittee passed the bill 7-0, including a “Yes” vote from Democrat John Ray Clemmons, with no discussion or questions, and will now move to the full House Health Committee.

SB1580, the Senate companion to this legislation, has already passed the Senate, and the bill continues to show bipartisan support.

While not guaranteed, the bill’s success thus far in both chambers indicates a strong likelihood of making it all the way to the governor’s desk to be signed into law.
